By using our website or placing an order you agree to be bound by these terms and conditions (“T&Cs”) and the documents referred to within them. We reserve the right to modify these T&Cs at any time. For further information, please contact our Customer Service team or see our FAQs.
In the event you have a complaint regarding a product or service purchased from Premsons, please contact our Customer Service team.
SHOPPING AT PREMSONS
You can shop with Premsons in the following ways:
• By visiting our Breach Candy, Mumbai store (In-Store Purchases);
• By placing an order on Premsons.com (Online Orders); or
• Ordering by phone (Phone Orders), either:
- By calling our Customer Service team to place an order online (Online Phone Orders)
- By calling our Mumbai store to place an order directly with the relevant department (In-Store Phone Orders).
Depending on how you place your order, different terms and conditions may apply (for example, the processes for deliveries and returns).
ONLINE ORDER PROCESS
By placing an Online Order or an Online Phone Order with us, you confirm that the information you provide is true, accurate and complete in all respects. By placing an order you confirm that you are over 18 years of age.
• The steps required for a binding contract between you and Premsons are outlined below:
You place an order for products or services:
a. Online Orders: when you press the 'Pay Now' button at the end of the online checkout process.
b. Online Phone Orders: a member of our Customer Service team will ask you to confirm that you wish to place the order.
• You will be given the opportunity to confirm the details of your order, including your address and payment details, prior to completing your order.
• When you place an order, we will send you an acknowledgement email to let you know that we have received your order. This is not an order confirmation or acceptance. We will request pre-authorisation against your payment card at this stage.
• We will send you a confirmation email to confirm that your order has been dispatched for delivery. This is confirmation and acceptance of your order. Your payment card will be charged on dispatch*.
• Unless otherwise agreed, your order will be delivered within 30 days of confirmation of your order (please see our deliveries and returns page for more information on our standard delivery times). Where we are unable to deliver your order within this period, we reserve the right to cancel your order.
• We may contact you if we cannot accept your order, which may be the result of (i) the products not being available, (ii) there is a problem with your payment method, (iii) there has been a pricing or product description error on the website, (iv) we are unable to deliver the products due to local import restrictions or requirements at your delivery destination or (v) you don’t meet our eligibility to order criteria or are in breach of any of the T&Cs or other law.
PRICES & PAYMENTS
We accept payment by American Express, MasterCard, Visa and Visa Debit, Premsons Gift Cards and PayPal (and other card providers as provided by Premsons from time to time).
However, for Online Orders delivered within India, we only accept payment in Indian Rupees Paise. If you choose to pay using a payment card with a foreign currency-denominated account for an India delivery, the payment will be taken in Indian Rupees Paise. Your payment card issuer will then convert the Indian Rupees Paise value, using their foreign exchange rates.
All prices shown on the website are inclusive of GST and other local taxes applicable to your selected delivery destination, where applicable. If you have not chosen your delivery destination, prices shown will be inclusive of GST only (for full information please refer to Delivery below).
We take all reasonable care to keep the details of your order and payment secure. However, unless we are fraudulent or negligent, we will not be liable to you for any losses caused as a result of any unauthorised access to this data by a third party.

Deliveries will be carried out by third party couriers, however please note:
- For all deliveries of In-Store Purchases, any Phone Orders, and India deliveries of Online Orders, your contract for delivery is with Premsons (Premsons House, 63; Bhulabhai Desai Road, Breach Candy, Mumbai - 400026).
- Please note that we are unable to deliver certain products (such as alcohol, knives, beauty and fragrance, wood products, and perishable items). For a full list of these products please see deliveries and returns. This list may be subject to change, including for reasons of local import restrictions in your chosen delivery destination. Information on delivery restrictions is also shown on individual product pages.
- We recommend that you make yourself aware of local duties and any other requirements before placing your order.
- If we are unable to obtain the relevant documentation required for your delivery, we may need to cancel your order.
Premsons offers the following rights of return:
Unwanted products may be returned for a refund or exchange if they are returned unused and in their original condition. Please note that the removal of security tags will be taken as evidence of use of a product by you and the product cannot be returned in these circumstances.
Returns must be made within 14 days with proof of purchase and are subject to exclusions and restrictions that are listed below (please note Non-Returnable Products below). If you need to return large or heavy items, please contact our Customer Service team.
Refunds will be provided against the original form of tender (except for the following items for In-Store Purchases, which will be refunded as a Gift Card: jewellery, watches, Sale items and special orders).
If the products have decreased in value due to the way you have handled them, we may deduct the amount of such loss from the amount reimbursed to you. If you are returning your product by post, please include your personal details and the best way for us to get in touch with you, otherwise we will be unable to process your refund.
Refunds and exchanges on purchases made on an event day or with other promotional discount will be calculated at the reduced price. Where a complimentary gift has been issued with a purchase, the gift must also be returned.

If you believe your products are faulty, please contact our Customer Service team.
This policy may be changed from time to time at our discretion.
Non-Returnable Products: The following products cannot be returned (whether bought online, by phone, or in-store):
- products that are personalised, bespoke, altered, or otherwise made to your specification
- perishable goods (including food and beverages, and some hampers)
- beauty products and fragrances
- certain accessories (hosiery and pierced earrings)
- underwear, nightwear, and swimwear, unless the protective adhesive strip is still in place and in a saleable condition
- mattresses, divans (where they come as part of a set with a mattress), duvets, mattress toppers/protectors, or pillows
- pharmaceutical products
- newspapers and magazines (unless bought on subscription)
- any other products designated as non-refundable at the time of purchase
In addition to the list above, the following items cannot be returned for In-Store Purchases:
- limited-edition items
- millinery, scarves, and hair accessories
- certain homewares
Refunds and exchanges will not be permitted for In-Store Purchases on Sale purchases after the last day of the applicable Sale.
Returns Process: In-Store Purchases and In-store Phone Orders can be returned to our Breach Candy store either in person or by post (by sending the product back to Premsons House, 63; Bhulabhai Desai Road, Mumbai - 400026).
Online Orders and Online Phone Orders delivered should be returned in any of the following ways within 14 days of cancellation.
- By visiting our Customer Service team in our store; or
- By using your own courier to return the products to: Premsons House, 63; Bhulabhai Desai Road, Mumbai - 400026.
PRODUCT DESCRIPTIONS, PRICING AND AVAILABILITY
We will take all reasonable care to ensure that all details, descriptions and prices of products on our website are accurate and kept up to date. We do not guarantee that the product images you see are an accurate representation; for example, colours may differ from the images shown on the website due to your computer/device screen resolution or settings.
Errors may sometimes occur in our pricing. If we have made an error in the price of a product you have ordered, we will contact you. You will have the option to reconfirm your order at the correct price, or the order will be cancelled. Prices may change and offers may be withdrawn at any time. Offers and promotions may be available online only or in-store only. Please check the terms of the relevant offer.
All orders are subject to availability. Once a product is sold out, it will be taken off the website and may not be available again. If products that you order are out of stock we will contact you and may cancel the whole or part of your order. Substitutions will only be made with your prior consent.
If a replacement product has a higher price, you will be liable to pay for the difference in price. If we are unable to contact you, we may cancel the whole order or the relevant part of the order and process the remainder of the order at our discretion.
GIFT CARDS AND GIFT MESSAGES
Gift Cards can be used for full or part payment for products and services for In-Store Purchases and Online Orders. The balance of a Gift Card may be used until either it is fully depleted or the Gift Card has expired. The Gift Card will expire after 24 months of non-use.
Premsons is not responsible for lost, stolen, expired or damaged Gift Cards. If there is any remaining balance on a lost, stolen, expired or damaged Gift Card, Premsons may (in its discretion) be able to issue you a new Gift Card for the remaining balance. However, where a Gift Card has been lost or stolen, Premsons will not be liable for any unauthorised purchases using the Gift Card prior to the cancellation of the Gift Card and any balance transferred to a new Gift Card will be less the value of those purchases.
Gift Cards are non-refundable and may not be exchanged for cash. Refunds for returns on purchases made using a Gift Card will be issued to a new Gift Card.
You are responsible for the content of gift messages and we accept no liability for any such content. We reserve the right to refuse to send messages or to discontinue access to the gift message service at any time entirely at our own discretion and without liability to you.
FOOD PRODUCTS, HAMPERS
For specific information about ingredients and allergies in any of our food products, please contact our Customer Service team.
If it is necessary, we may substitute a product within a hamper. The replacement product will be of equal or greater value than that which it replaces.
Liability: You agree to indemnify us and our agents and officers, directors and employees, immediately on demand, against all claims, liability, damages, costs and expenses, including reasonable legal fees, arising out of any breach of these T&Cs by you or by any other person accessing the website using your account and/or your personal information.
To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the products and services offered by Premsons.
We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the Conditions for (i) any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or (ii) any loss of goodwill or reputation; or (iii) any special or indirect losses, suffered or incurred by that party arising out of or in connection with the provisions of any matter under these T&Cs. Nothing in these T&Cs shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our agents or employees.
Waiver: No waiver by us shall be construed as a waiver of any right for any breach of these T&Cs.
Severance: If any of these T&Cs shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable and shall not affect the validity and enforceability of any of the remaining T&Cs.
Entire Agreement : These T&Cs govern our relationship with you. You agree that you have not relied on any representation outside of these T&Cs. Your Consumer Rights are not affected by these T&Cs. Nothing in these T&Cs shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation.
Law : These T&Cs shall be governed and construed in accordance with Indian law and you agree to submit to the exclusive jurisdiction of the courts of --

Information Collected When You Make A Purchase
When you make a purchase at any of our retail outlets or online, we will collect necessary information about you to ensure we can fulfil your order or chosen service.
If you choose to pay by card, we will need to collect your payment information in order to process card payments. We may also need to ask for additional information from you, e.g. to prevent fraudulent transactions, to comply with anti-money laundering obligations for high value transactions, or to ensure that we comply with our legal obligations such as age restrictions applicable to the sale of guns, knives or alcohol, or the legal requirement to share your details with the TV Licensing Authority when you purchase a television.
Where you place an order with Premsons for products or services that will be delivered, collected or provided at a later date, we will need to take additional contact details and delivery information from you so that we may complete your order. We may use third party couriers to deliver your order and will need to share your contact information with them for this purpose.
Managing Your Marketing Preferences
At any point that you interact with us, you may be given the opportunity to opt-in to receive Premsons marketing communications. Premsons will only send you marketing communications where you have consented to receive them and using your preferred channels of communication. To ensure that you are still happy to hear from us, if you have not updated your marketing preferences in two years, we will contact you to remind you that you can opt-out of receiving marketing communications at any time:

When you make a purchase on premsons.com, we will collect information about you to ensure we can fulfil your order or chosen service (including your name, contact details and delivery address). You will be offered the opportunity to use our guest checkout path or to create an online account on our website. In order to register an online account, we will ask you for your name and contact details. You will also be asked to create a password. Once you have created an account, this will serve as a platform to update your marketing preferences.
If you have Wi-Fi capabilities switched on and/or Bluetooth enabled with the Premsons App open, we will collect location information from your device about the route you took around the Store. Premsons uses this information to understand the more popular routes and destinations chosen by our customers so that we can improve our navigation strategy and customer experience. If you want to disable this functionality, please turn off Wi-Fi, Bluetooth and Location Services in your device settings when you visit the Premsons store.
To make your journey around our Store more comfortable, we are continuously seeking to understand the easiest ways of navigating our building. While you are walking around the Premsons Store, we collect thermal footfall information to understand visitor journeys better and visitor “traffic” levels across different parts of the Store.
Competitions, Prize Draws, Giveaways And Offers, Events
To ensure your safety and for the prevention and detection of crime, CCTV is in operation during your visit to our store. Please be aware that if we are requested to provide CCTV images of you or any other personal information relating to you by the police or any other regulatory or government authority investigating suspected illegal activities, we are obliged to do so.
How Can You Manage The Information We Hold About You?
As part of our commitment to exceptional customer service, where you have provided your consent, we personalize your experience, by only sending marketing communications about the most exclusive products, services and events that we believe you will be interested in. You have always been able to opt-out of these communications but now it is easier than ever to manage your preferences by contacting our Customer Service Team or by email at email@example.com
You can also unsubscribe from individual email marketing communications via the “Unsubscribe” link at the bottom of each of our email marketing communications.
Should you wish to know more about what information we hold about you including making changes to, or requesting the deletion of, information that we hold about you, you are also entitled by law to make a Data Subject Request. Please note that we may need to exclude certain information as part of your request, e.g. in order to protect the privacy of other individuals or if we are permitted to exclude the information for legal or other reasons.
How Do We Keep Your Information Secure?
We make sure that we have information security measures in place to keep your information secure. Where we ask third parties to work on our behalf, before sharing information we always make sure that they have sufficient information security measures in place.
Information you provide to one of the Premsons companies may be shared within the Premsons Group of companies. We also work with a number of third parties to help us deliver an excellent service to you. We require all third parties that interact with information to undergo an Information Security Due Diligence Assessment to ensure that information is only shared where third parties have appropriate security measures in place.
We will not share your information with any third parties who might wish to market their goods and services to you unless you have provided your consent. Premsons does not routinely share information. If it is necessary we will only do so with the relevant protection in line with data protection legislation requirements.
How Long Will Premsons Keep My Information?
Premsons is committed to keeping your personal information only for so long as is necessary or where we have a legitimate interest to continue doing so. Where Premsons no longer requires information to be in a format where you can be identified personally, e.g. where we keep information for analytical and research purposes or transaction information, we will remove any personal details about you.
If you have registered for an account on premsons.com, then we will continue to retain your personal information in order to maintain your account. We understand that some of our customers do not shop with Premsons on a regular basis, but if you have not made a purchase with Premsons for a continuous period of four years, then we will delete your account details and all personal information that we hold about you. If you wish to use your account after this time, you will need to sign up to a new account.
If you have not registered for an account on premsons.com, but you have signed up to receive Premsons’ marketing communications, then Premsons will only retain your information for as long as we have your consent to send you marketing.
Where you shop online with Premsons but use our guest checkout path, we will only retain your personal details for a reasonable period of time after you have completed the transaction in order to fulfil any contractual obligations such as refunds and guarantees (unless you also receive Premsons.com marketing communications, in which case we will add this order information to your customer record).
Please note that if you have registered for an account on premsons.com, but choose to use our guest checkout path, we will add the guest checkout purchase to your customer record internally automatically. It will not be visible on your order history page as that will only show orders though the registered user journey. If you would prefer for this not to happen, then please use a different email address not already registered with Premsons.
When you contact Premsons through any channel (including by phone, post, email or social media), we will collect information about you in order to respond to your query, request or feedback. Please note, if you contact Premsons by phone your call may be recorded for quality, training and security purposes. Additionally, calls may be monitored (without your consent) to allow Premsons to collect information for security and regulatory purposes.
If we specifically change the way in which we use your personal information or if we need to notify you about a change to the information that we hold about you, we will specifically contact you.
Security of our website is of utmost importance to us. Our site uses software to provide high-level encryption technology. Although we use advanced security measures to protect your information against loss, misuse and alteration, as is the case with all computer networks linked to the internet, we cannot make absolute guarantees over the security of the information you provide over the internet and as such, we cannot be held responsible for it.
We will never contact you by email to ask you to send or confirm any of your personal details, if we need any information of this nature we will only contact you by telephone.
Never send any sensitive information, such as passwords or credit card information, via email.
Where you have chosen to create a password to access certain parts of our website, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.
